Patients must also have one of the following associated symptoms caused by these conditions: cachexia or wasting syndrome, severe or chronic pain, severe nausea, seizures, severe or persistent muscle spasms.

Physicians will not “prescribe” medical marijuana in the same way other pharmaceutical medications are prescribed to patients. Physicians through the NYS Medical Marijuana Program may issue a written recommendation to a patient that has been diagnosed with a condition eligible for therapeutic use of marijuana. After obtaining a written recommendation from a certified physician, patients can register as a medical marijuana patient, and travel to a medical marijuana dispensary to purchase the medication.

A New York medical marijuana patient must have their medical marijuana card on them at all times, as this is protection against any legal prosecution. The State has created a patient database to issue a particular certification number for alternative medicine. In addition, the recommending physician is required to explain the potential risks and benefits medical marijuana use to the patient, or their legal guardian.
